Filming Motocross (or generic outdoors activity)

Hi All, long time reader, first time poster :)

I got talking with someone at my local BMFA club whilst I was flying my hex, he now is into motocross, and said there might be an opportunity or two for me to pop down and do some filming from the air.

Now I';m not BNUC / RPQ qualified, so can';t do "Commercial Aerial Work", which is fine, I don';t want to make any money at the moment, just keep this as a hobby, but I';m wondering about the CAA rules & reqs, specifically (167) "within 50 metres of any vessel, vehicle or structure which is not under the control of the person in charge of the aircraft"

Clearly I would the person in charge of the aircraft, and I cannot be (nor really want to) riding (thus directly controlling) the bike(s), so I';m wondering what classifies as ';under the control of';?

At 50 meters away the bikes going around would look like little ants, so I';m wondering if anyone has any suggestions about how to (safely/legally) get closer. (short of getting qualified and then getting caa approval!)

Clearly we aren';t all legal experts, nor is this a legal advise forum so I';m not going to hold anyone to their word, but just wondering if anyone has done the same. Would briefing the rider(s) on what I plan to do and what to do if it falls out of the air onto the course, then staying to the edge of the course, not over the track work?

Any thoughts?

FWIW, my take on "under the control of" would be satisfied by a (preferably written/signed) agreement (or perhaps disclaimer) from the people you';re going to fly within 50meters of. So you might want to hold a little meeting, point out what the safety risks are and then explain what you';re going to do, followed by "any questions?" and ask they sign

^^^ What he said...under your control means you have instructed them that you will be operating in the area and give them an opportunity to object.  This is why for example you can';t fly over a large assembly of people, as whilst you may in some way advise them they won';t necessarily have the opportunity to voice concerns (ie pop concert).
