Can I fly in the Lake District NP???

Hi I';m new to drone';s but want to make sure I stay legal, I came across a comment on a youtube video saying flying over the NP is banned, so after having a quick google I';m getting mixed answers the National Trust say you can';t fly over their land.

But on the Lake district website says "If you wish to fly a small drone within the area of the Lake District National Park, you must comply with the Air Navigation Order 2009"

I';m finding it hard to believe that the NT can stop me flying over 2,362 km² of land most of which they don';t own???

Any help would be welcomed

I fly quite a few places in the Lakes. I just make sure I stay away from people and low flying jets  :o

I';ll deal with the NP if someone complains.

I say print the webpage that says you can fly small drones in the Lake District and keep it in your pocket. But be sure NOT to fly anywhere within a National Trust boundary.

YouTube vids carry a lot less weight than an official website or posted bylaw.

atomiclama: I';m based in the southwest part of Cumbria just outside of the NP already checked out a couple of nice areas to fly with no one around, advantage of living in the middle of nowhere I guess

LuMan: not a bad shout, I remember having the same problem with my off road bike on the green lanes, even if you know you';re in the right you still get people moaning...

I thought that if you had permission from the landowner, you had not accepted any money, you where doing it as a hobbyist, you stayed away from people and livestock by 100m, and was a safe drone operator....not CAA then you could fly? A national park is great but parts are still owned by people. The land registry gives you details on who owns the land so by rights if you get there permission you are ok? Obviously not if you are in the centre of some town. Surely you can still fly above land which you have permission on by the landowner? Dont you own the land and above to a certain degree?

It pisses me off this, as even though I am a hobbyist, maybe even a newbie to most, rules are rules! Idiots and chavs go out and buy a drone and fly it like shite! but us people who are genuine get treated by the same label. I know I am jumping on my horse, but I have the same problem and I am based in South Yorkshire, the only place I get to fly is over old pit stacks, and they are becoming boring now! You say drone and everyone comes out with a story that it flew over there house, or city, or land...blar...blar... I have even enquired about renting land and you just get talked to like your UAV drone Multicopter is a husband £30 quid mess.........rant over.....

Spot on, poseiden. I asked a local(ish) landowner if I could fly in his paddock (which he does rent out) and he tried to charge me 300quid an hour! Apparently it';s the ';going rate';.

I think he was offended when I laughed in his face.

TBH if any locals have a field and let me fly, then I';d offer to mow it for them!! Only seems fair.

I always had it in my head that National Trust was  land /property that was held in trust for the benefit of everybody, some of it has entry charges to help maintain it but essentialy free.
On a slightly different tack English Heritage sent me  a flier inviting me to join, only £43.50 for a year.
I clicked on the map to see which local places i could visit , no enty fee for members,  one of them was Queen Elanors Cross,  the fact that it';s on the side of a road and can be visited by anybody for f/a  seems to have overlooked. :shrug:

Spend the 300 quid on a new fpv quad,,,, park next to the field and just fly over it  :laugh:

The permission you need is to take off and land.  National Parks and public parks and beaches unless they specify no remote piloted aircraft written in to their policy or bylaws. Then I would say you can fly a remotely piloted aircraft. Irrespective if you call this a drone, SUAS, UAV, aeroplane, helicopter or glider. However you must still fly by the rules set by the CAA. So no higher than 121m from ground level. No further away from you than 500m. Must always be able to see your aircraft line of sight. Not taking off closer than 30m to Jo public. Not flying closer to Jo public than 50m. You are satisfied that your flight can be conducted safely.  You are not flying over a congested area such as a town of village. Be mindful of the images you take and what you do with them. And always think if I was the Jo Public would I be concerned if I saw a remotely piloted aircraft close to me.  Until the law changes, which it most definitely will in 2017, fly responsibly and most of all have fun.

Clause 18 outlines what you can and can';t do:
18 Kites and Model Aircraft
(1) No person shall fly a kite or model glider from the access land in such a manner as to give reasonable cause for annoyance to any other person or in such a manner as is likely to startle or disturb stock on the land.
(2) No person shall release any power-driven model aircraft for flight or control the flight of such an aircraft on or over the access land unless he is authorised to do so by the Authority.
(3) For the purpose of this byelaw "model aircraft" means an aircraft which either weighs not more than 5 kilograms without its fuel or is for the time being exempted (as a model aircraft) from provisions of the Air Navigation Order and "power driven" means driven by the combustion of petrol vapour or other combustible vapour or other combustible substances or by one or more electric motors.
You are allowed to fly gliders but that';s about it, this refers to National parks and Forestry commission land, there is the proviso "Authorised to do so by the authority".
